All purchases made through the portal www.fruteq.com (hereinafter, the Website), owned by SERVICIOS AGRICOLAS FRUTEQ, S.L., are subject to the general conditions set out in the legal notice. The General Conditions prevail over the Online Purchase Conditions.

All products and services are subject to the following conditions. By purchasing on the Web, you automatically agree to these terms. Please read them carefully.

These conditions constitute the entire agreement between the parties regarding the online purchase and sale transactions between SERVICIOS AGRICOLAS FRUTEQ, S.L. and its customers.

SERVICIOS AGRICOLAS FRUTEQ, S.L. is empowered to unilaterally modify each and every one of the obligations set forth in these conditions, without prior notice. Likewise, it is able to restructure, modify or eliminate any information, service or content included on the Web, without prior notice.

A purchase is not final until it is accepted by our Administration Department. SERVICIOS AGRICOLAS FRUTEQ, S. L. reserves the right of admission and cancellation of any order and can return the amount paid by the customer and shall be exempt from any further obligation.

The Web does not require prior subscription for the simple navigation, access or use of the service in question.

USER REGISTRATION

To buy in SERVICIOS AGRICOLAS FRUTEQ, S.L. online shop you can register in it. Your data will be saved, and your future purchases will be faster. You must add the desired product to your basket. Once you have checked the contents of your basket, you will see the option “Finalise purchase”. On the next screen you must enter your delivery details. The User undertakes to select, use, and keep his username or “login” and his password (hereinafter the “Access Keys”) in accordance with the provisions of the following clauses.

Use and ownership

The User undertakes to make lawful and diligent use of the Access Code, as well as not to make their Access Code available to third parties.

The User undertakes to reliably communicate to the Webmaster of SERVICIOS AGRICOLAS FRUTEQ, S.L., as soon as possible, the loss or theft of the Access Keys, as well as any risk of access to them by a third party.

The Access Key may only be used by the Users to whom it has been assigned. SERVICIOS AGRICOLAS FRUTEQ, S.L. is exempt from any type of liability that may accrue for damages caused or suffered by fraudulent use or lack of diligence in the custody of the Access Code, loss or use contrary to the provisions of these Conditions.

At any time you can request to unsubscribe as a Registered User by sending an email to baja@fruteq.com explaining the details of the user to unsubscribe.

All products sold on this website are new and original from the producer/manufacturer.

The information provided should not be considered complete or exhaustive at any time due to the wide range of products and services available in the sector. SERVICIOS AGRICOLAS FRUTEQ, S.L, for its part, will try to the extent of its possibilities to constantly update the prices of the products through constant communication with suppliers and manufacturers.

SERVICIOS AGRICOLAS FRUTEQ, S.L. declares that the product offered usually corresponds to the photograph and technical description of the same. However, it is exonerated from liability for those cases in which, due to technical or human error, there are mistakes or variations between the photograph, the technical description and the price. Likewise, it is made clear that the photographs are merely indicative and that there may be variations in terms of physical appearance, but without affecting the integrity and performance of the product ordered.

SERVICIOS AGRICOLAS FRUTEQ, S.L. is not responsible for the contents, information, opinions or comments disseminated through the Web, nor will it be liable for the use that the User makes of this information.

PRICE LIST

The price of the products is in EUROS and includes the taxes of the Law according to the Spanish Legislation. The final purchase summary shows the final or total price of the same, indicating the quantity corresponding to the price of the determined product and the quantity corresponding to the applicable taxes.

Based on its commercial policy, SERVICIOS AGRICOLAS FRUTEQ, S.L. may make final price variations either by loyalty, by acquisition of products of certain entity or relevance, as well as others that may stipulate SERVICIOS AGRICOLAS FRUTEQ, S.L. in due course. However, it will be SERVICIOS AGRICOLAS FRUTEQ, S.L who freely and voluntarily offers these discounts and/or rebates, to whom it deems appropriate, and cannot be required or requested at any time by the client.

All prices include shipping. The prices are valid except typographical error. All sales are made with the corresponding invoice. Products are available for sale until end of stock

PAYMENT METHODS

Once you have reviewed the content added to your basket, you will need to click on “Finish Purchase”, and you will move on to Shipping and Payment. On the next screen, you must enter the shipment data, and then make the payment according to the chosen method, by clicking on “Finish order-Payment obligation order”. Once the payment is completed, you will see the order registration confirmation and you will immediately receive this confirmation in your email.

The invoice will be issued, with the data provided for this purpose once the payment of the order has been confirmed and the order has been received and managed. You can obtain the invoice in the following ways:

  1. Sending to your email address.
  2. Shipping along with the order.

Option 1: Transfer

If you prefer to pay by conventional bank transfer (you write down our account number and make the transfer in person at your nearest bank), you must make the transfer to the Banco Santander account IBAN ES31 0049 0238 6322 1021 6454.

It must be made in Euro currency.

It is important that you indicate in Concept: “Order nº…”, as well as your name and surname.

It is important that you make the transfer within 3 days of placing the order, to prevent your order from expiring.

The order will not be considered effective until SERVICIOS AGRICOLAS FRUTEQ, S.L. can effectively confirm that the payment has been made. If you wish to speed up the process, you can send us the receipt of the transfer by e-mail to tienda@fruteq.com.

Remember that all possible exchange and bank commissions are your responsibility when you choose this payment system.

Option 2: Credit or debit card

In order to make a payment by credit or debit card, it is necessary to use a card ISSUED IN SPAIN and in which the “MasterCard SecureCode” or “Verified by VISA” secure payment systems have been activated, as appropriate. If you have questions about how to activate your card’s secure payment system, please check with your bank.

To provide greater security to credit card owners, VISA has included a three-digit number on their cards called CSC that serves as an identification code to verify the physical presence of the card during transactions over the Internet. This three-digit number is printed on the back of your VISA card (in the signature area), immediately after the card number. To prevent fraudulent transactions with credit cards, SERVICIOS AGRICOLAS FRUTEQ, S.L. reserves the right to request these check digits from its customers before sending the order.

Credit card fraud is a crime, and SERVICIOS AGRICOLAS FRUTEQ, S.L. will take legal action against anyone who makes a fraudulent transaction in our online store.

SERVICIOS AGRICOLAS FRUTEQ, S.L. keeps track of each transaction and will use all the means available by the Law so that those who make fraudulent purchases are sanctioned by the authorities.

DELIVERIES

In SERVICIOS AGRICOLAS FRUTEQ, S.L. we do not use chemical products or cold rooms to advance the ripening of the fruit. Our product matures in the tree with its natural rhythm of life. Once the order arrives, we collect the fruits and send them. In this way they arrive freshly picked from the tree.

Each piece of fruit is picked with scissors, one by one and selected to meet high quality standards. However, they are natural products, which are not treated with chemicals to extend their useful life. It is possible that some piece arrives in bad condition, so in anticipation of this happening, in the box there will always be some unit more than those requested.

In case of rain, no fruit will be harvested as it will spoil. Deliveries will therefore be postponed until weather and terrain conditions permit.

SERVICIOS AGRICOLAS FRUTEQ, S.L. will not send any product until the Administration Department has verified that the payment has been made.

Delivery shall be deemed to have been made at the time when the carrier has made the products available to the customer and the customer has signed the delivery receipt document. It is up to the customer to verify the products upon receipt and to state all the caveats and claims that may be justified in the delivery receipt document.

SERVICIOS AGRICOLAS FRUTEQ, S.L. will send the products by the means it deems appropriate to fulfil its commitments.

Shipping to the Balearic Islands, Canary Islands, Ceuta, and Melilla is currently unavailable.

Shipping costs

SERVICIOS AGRICOLAS FRUTEQ, S.L. offers convenience and flexibility, so orders are shipped FREE OF CHARGE. Neither will transport costs be charged when it is an exchange or return for reasons attributable to SERVICIOS AGRICOLAS FRUTEQ, S.L. All orders confirmed on the Web are sent within a maximum period of approximately 1 to 2 working days by one of our courier services. In order to optimise delivery, you must indicate an address to which the order can be delivered during normal working hours.

The delivery person will deliver the order during working hours. If the delivery cannot be made after two unsuccessful attempts, then the delivery driver will notify the impossibility of making the delivery due to the absence of the addressee and will leave a note for you to go to the nearest office for collection at the office. The SERVICIOS AGRICOLAS FRUTEQ, S.L. online shop does not deliver to PO boxes. Please provide all the necessary details for delivery to your delivery address. Having complete information allows us to deliver your order on time.

Delivery term

Orders received before 8:00 a.m. Monday through Thursday will be delivered the day after order validation. No products are sent from Friday to Sunday or holidays so that the fruit is delivered at the time closest to its collection.

Therefore, if an order is placed from Thursday from 8:00am to Monday before 8:00am, it will be delivered on Tuesday or the first working day after it is shipped.

However, these deadlines are indicative and may vary for reasons beyond our company’s control. SERVICIOS AGRICOLAS FRUTEQ, S.L. does not commit to any specific delivery time since the shipping process depends on third parties.

If a delivery is going to take longer than 3 business days, SERVICIOS AGRICOLAS FRUTEQ, S.L will contact the customer to let them know and give them the option to cancel the order and receive their money back immediately by bank transfer.

Stock Breakage

On the website we only offer for sale products in stock, either in the field, in our own warehouse or in the warehouse of an entity, manufacturer or wholesaler, which allow us to serve the product in the time described as delivery time. However, the synchronisation of the website with the warehouses is not instantaneous. In addition, in the period between a customer registering an order on the website until we receive and process the proof of payment, some products may run out of stock. As a result, there may be isolated cases where we are unable to deliver an order due to stock shortages.

When it is not possible to deliver a product due to lack of stock, SERVICIOS AGRICOLAS FRUTEQ, S.L. will contact the customer to inform them, cancel the order and return their money immediately by bank transfer.

In these cases, the amount will always be refunded to the customer and the order will be cancelled. IT WILL NOT BE POSSIBLE TO KEEP THE PRICE OF THE PRODUCT OUT OF STOCK TO SERVE IT WHEN STOCK IS REPLENISHED, since the price of the product changes in each replenishment according to our purchase price.

Cancellation of Order

If the customer cancels all or part of the orders before SERVICIOS AGRICOLAS FRUTEQ, S.L. has issued them, SERVICIOS AGRICOLAS FRUTEQ, S.L. may demand the payment of compensation for expenses and processing, consisting of 5% of the value of the rejected goods. Customers may adhere to any of the payment methods offered by SERVICIOS AGRICOLAS FRUTEQ, S.L. In the event that the customer accepts prepayment as a form of payment, it will have all its effects proceeding the customer to pay for the product after placing the order. The purchased products must be paid after placing the ORDER by sending to SERVICIOS AGRICOLAS FRUTEQ, S.L. the amount contained therein, through one of the means of payment selected.

Each shipment is accompanied by a copy of the delivery note or invoice detailing the goods of the complete order accompanying each shipment. The receiver is obliged to check that the number of his order and that of the delivery note coincide. Likewise, it must be checked that the number of packages appearing on the carrier’s Delivery Document coincides with the number of packages delivered.

Upon delivery of the goods, the User must sign the delivery note giving their consent to the delivery made. The customer’s agreement in the delivery note implies the waiver of any type of claim or complaint regarding the goods ordered and received.

Both to make the insurance effective and to correct any error in the delivery, it is an essential condition that it is stated in the observations section of the delivery document of the carrier, any incident with respect to the goods received or their packaging. It is also essential that you notify SERVICIOS AGRICOLAS FRUTEQ, S.L of this incident within a maximum of 24 hours, either by phone or by email to tienda@fruteq.com

If these conditions are not met, SERVICIOS AGRICOLAS FRUTEQ, S.L. will not assume any responsibility for those goods.

WARRANTY

Fresh products do not have additional guarantees since they are exquisite and perishable products, that is, for immediate consumption, so they are guaranteed to be fresh and in good condition at the time of delivery. SERVICIOS AGRICOLAS FRUTEQ, S.L. is not responsible for the conservation, treatment, or distribution that the customer or user may give to them once delivered.

The products do not have a guarantee if they have begun to be consumed or, if they have passed the expiration period of preferential consumption established, nor do they have a guarantee of return protected by law due to their nature of consumer goods.

RIGHT OF WITHDRAWAL AND REFUNDS

The right of withdrawal is the consumer’s right to cancel the order placed and return what he has purchased, without having to justify his decision. In the case of fruit, there is no right of withdrawal in favour of the consumer as it is a perishable product.

However, the satisfaction of our customers is a priority. In case of wanting to return the delivered product during the 24 hours after its delivery, you can do it in various ways:

  • If you choose the option of returning the product to the SERVICIOS AGRICOLAS FRUTEQ, S.L. office, you must contact our Customer Service Department in advance, on the phone (+34) 626 096 718 who will send you a return authorization that you will have to send to the same office.
  • If you choose the option of returning the product through the online store of the Web, you must contact our Customer Service on the phone (+34) 626 096 718 or through the email account tienda@fruteq.com to unequivocally state your decision to withdraw from the contract.

The right of withdrawal will be understood as exercised within the period when you have sent us the communication regarding the exercise of this right before the end of the corresponding period, in the terms indicated above.

Consequences of withdrawal: In the event that you exercise the right of withdrawal, we will refund all payments we have received from you, including delivery costs without any undue delay and, in any case, no later than 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. We will proceed to make such reimbursement using the same means of payment in which the purchase was paid without incurring any expense as a result of the reimbursement.

If the product arrives in poor condition, SERVICIOS AGRICOLAS FRUTEQ, S.L. will bear the shipping costs incurred for the return, provided that the products are in their original packaging and have not been consumed in whole or in part.

In all cases, the products to be returned must be in perfect condition, in their original packaging and with the accessories and/or promotional gifts, if applicable, included. The right of return cannot be exercised when there are indications that the products have been opened, manipulated, or exposed to unsuitable conditions.

COMPLAINTS FORM

Complaint forms are available to the customer. The form can be requested from our customer service department by phone or by email, and we will send it to the address you indicate. You can also request it at our establishment, at CALLE ALQUERIA BLANCA 20 46510 – QUARTELL (VALENCIA).

JURISDICTION AND LEGISLATION

The parties submit themselves, for the resolution of conflicts and renouncing to any other jurisdiction, to the courts and tribunals of SERVICIOS AGRICOLAS FRUTEQ, S.L. Regarding the fundamental questions derived from the fulfilment/non-fulfilment of the agreed conditions, they will be governed firstly by what is agreed in the same and secondly by what is established in the Civil Code and complementary legislation applicable to the case.
